What is pile burning?

Burning of cut and stacked vegetation is referred to as a pile burn. Pile burns can be a useful method for reducing bush fire fuels, bush regeneration, property maintenance and agricultural activities.

Depending on the location, pile burns may require an ‘open burning’ approval from the local council or the NSW Environment Protection Authority. These locations are listed in Schedule 1 of the Protection of the Environment Operations (Clean Air) Regulation 2022.

There are three Parts to Schedule 1:

- Part 1: Areas in which all burning is prohibited except with approval.

- Part 2: Areas in which burning of vegetation is prohibited except with approval.

- Part 3: Areas in which burning of anything other than vegetation is prohibited, except with approval or in relation to certain domestic waste.

Proposed Amendment

The primary objective of the amendment to the Protection of the Environment Operations Act 1997 is to amend the current Schedule under the Protection of the Environment Operations (Clean Air) Regulation 2022 for the Campbelltown Local Government Area (LGA) to permit pile burning.

Why is this change being proposed?

Currently, under the Protection of the Environment Operations (Clean Air) Regulation 2022, the Campbelltown Local Government Area (LGA) is listed under Part 1 – Schedule 1, which prohibits all open burning, including pile burning, unless an approval is obtained from the NSW Environment Protection Authority (EPA). 

We are proposing a shift to Part 2 – Schedule 1, which would allow property owners on land 4,000 square metres or greater in Kentlyn, Long Point, Minto Heights and Wedderburn to undertake pile burning with approval.
